A Federal appeals court ruled in its decision that the Management on sanitary inspection behind quality of foodstuff and medicines (FDA) has no obligation to prohibit the addition of feeding antibiotics to healthy cattle (cattle), which is used for food. Consumer advocates already called the decision by the failure of the health system.

The court decision was announced amid fears that human tolerance to antibiotics commonly used in the production of cattle for food, is constantly growing. The problem was noted in the report of the Centre for control and prevention of diseases in the past year, which is recommended to minimize the misuse of antibiotics. In animal USA antibiotics are used to accelerate growth of animals.

In order to stop such practices are four groups of consumers ' rights protection in 2011 filed a lawsuit to force the FDA to ban the use of antibiotics in healthy animals - as long as the drug producers will not be able to prove that such application will not harm people. They claimed that management had to hold hearings to review the scientific evidence, and that the FDA illegally dismissed a couple of requests of citizens, demanding to hold a hearing.

"Beating off" from legal attacks, the Agency has taken a workaround. Representatives FDA has developed rules that encourage manufacturers to voluntarily follow the directives that limit the use of antibiotics in healthy cattle. But the initiative was met divergent responses, as for the pharmaceutical industry did not put forward strict requirements.

The decision of the court was concerned group of defenders of the interests of consumers, confident that the voluntary guidelines, drawn up in December of last year, will not be able to achieve this effect, which would be obtained under a ban.

They argue that antibiotics can still be used in order to prevent that allows the producers of drugs and food producers to circumvent recommendations FDA and endanger people's health.

The report of Robert Lawrence, who heads the Center of Johns Hopkins University, says that improper use of antibiotics contributes to the epidemic antibiotic resistance. The court's decision is disappointing, because of the voluntary guidelines do not replace decisive action in confronting one of the major health problems of our time.

As for the FDA, his representative commented that "the FDA is currently reviewing the court's decision, but rather the result".
