At the meeting the lawyer Irina Biryukova, acting in the interests of the company, stated that the criminal case is illegal. According to her, at the time of the complaint established that a tax audit is not completed, and those which were set out in the tax act, no confirmed yet because the materials field checks are still pending. Biryukov added that the company introduced materials that reflect the full legal VAT refund.

In turn, the investigator noted that the defense's arguments are unfounded, and asked to leave the complaint without satisfaction. The petition of the investigator supported the Prosecutor and added that information contained in the materials submitted to the tax office, not credible and require thorough review.

A criminal case was opened under part 4 of article 159 of the criminal code (Fraud) is the theft of almost 181,5 million rubles by illegal compensation from the budget of the Russian Federation the tax to the added cost of JSC "Lipetsk confectionery factory Roshen" (part of the confectionery Corporation Roshen, owned by the President of Ukraine Petro Poroshenko). These fake documents later served as the basis for transfer to the settlement account of JSC "Lipetsk confectionery factory Roshen" more than 180 million rubles as of illegal VAT reimbursement.

Basmanny court of Moscow has previously imposed a security a lien on the property of a confectionery factory in a criminal case. Arrested were: warehouse, four shops, a utility building housing, seven plots of land belonging to the factory. The arrest was effected until September 13. In this case the seized property can be exploited by the factory, however, it is impossible to carry out the transaction. This decision was also appealed in the Moscow city court.
